What Oklahoma Law Means for Your Claim

• Two-year deadline. Oklahoma gives you two years from the accident date to file a lawsuit (12 O.S. § 95). Miss it, and you likely lose your right to recover, regardless of how strong your case is.
• Fault-based system. Oklahoma is an at-fault state, so the driver who caused the crash, whether through distracted driving, speeding, impairment, or failure to yield, is financially responsible for the damages that follow.
• 50% bar on fault. Under the modified comparative negligence rule (23 O.S. § 13), you can still recover damages if you're 50% or less at fault. Your award is reduced by your percentage of fault; 51% or more bars recovery entirely.
• $500,000 cap on pain and suffering. For bodily injuries occurring on or after September 1, 2025, noneconomic damages are generally limited to $500,000 under 23 O.S. § 61.3. Statutory exceptions apply to permanent and severe physical injuries, certain permanently disabling mental injuries, and qualifying reckless, grossly negligent, fraudulent, intentional, or malicious conduct.

What If I Wasn't Wearing a Seatbelt?

Not wearing a seatbelt does not automatically prevent you from recovering compensation. Oklahoma law generally allows seatbelt use or nonuse to be introduced as evidence; however, the defense may argue that it contributed to the severity of your injuries. The effect depends on the medical evidence and the circumstances of the crash.

Should I Accept the Insurance Company's First Settlement Offer?

Do not accept an offer until you understand the extent of your injuries, the treatment you may still need, and the losses covered by the release. Once you settle and sign a release, you generally cannot seek additional compensation if your condition later worsens.

Can I File a Claim If the Police Report Doesn't Assign Fault?

Yes. A police report is helpful evidence, but it isn't the final word on liability. We can build your case using additional evidence, including witness statements, vehicle data, and accident reconstruction if needed.
