- The attack occurred without provocation.
Under strict liability, you do not have to prove that the owner was negligent or that the dog had a history of aggression. If the dog bit you while you were minding your own business in a public park or as an invited guest in someone’s home, the owner is responsible for the damages.
The Location and "Lawful Presence"
To successfully pursue a claim, the victim must have been lawfully on the property. This includes:
- Public property (sidewalks, parks, stores).
- Private property when invited (social guests, postal workers, delivery drivers, or repair persons).
