Oklahoma Dog Bite Law: Understanding Your Rights

Oklahoma law is relatively favorable to dog bite victims compared to states that follow the "one-bite rule." In many states, a dog owner is only liable if they knew the dog was dangerous. Oklahoma, however, follows a strict liability statute for dog bites.

The Strict Liability Statute (Section 4-42.1)

According to Oklahoma Statutes Section 4-42.1, the owner of a dog is liable for damages if:

  • The dog bites or injures a person.
  • The victim was in a place where they had a legal right to be (public property or lawfully on private property).
  • The attack occurred without provocation.

Under strict liability, you do not have to prove that the owner was negligent or that the dog had a history of aggression. If the dog bit you while you were minding your own business in a public park or as an invited guest in someone’s home, the owner is responsible for the damages.

The Location and "Lawful Presence"

To successfully pursue a claim, the victim must have been lawfully on the property. This includes:

  • Public property (sidewalks, parks, stores).
  • Private property when invited (social guests, postal workers, delivery drivers, or repair persons).
