Oklahoma Rideshare Laws

Oklahoma regulates ridesharing under the Oklahoma Transportation Network Company Services Act. This legislation was designed to ensure that passengers and third parties are protected by establishing minimum insurance requirements that far exceed standard personal liability limits.

Under state law, Uber and Lyft are required to maintain primary insurance coverage that recognizes the commercial nature of their business. The law also mandates that these companies perform background checks on drivers and maintain vehicle safety standards. However, the law also provides a "shield" for the parent companies by classifying drivers as independent contractors rather than employees. Who is Liable for an Uber or Lyft Accident?

When the Driver Has Accepted a Ride or is Transporting a Passenger

This is the period of highest coverage. It begins the moment a driver hits "accept" on a ride request and ends when the passenger exits the vehicle and the ride is closed in the app.

  • Liability: The rideshare company’s commercial insurance policy is primary.
  • Insurance: Uber and Lyft both carry $1 million in third-party liability coverage. They also typically carry Uninsured/Underinsured Motorist (UM/UIM) coverage, which protects you if another negligent driver hits the rideshare vehicle and that driver does not have sufficient insurance.
