How We Build a Hit-and-Run Injury Claim

We start with the facts available after the collision, then develop the case step by step while preparing for the possibility of trial.

The process may include:

  • Initial case review: We discuss the collision, the other driver’s departure, your injuries, and the information currently available.
  • Investigation and evidence development: We examine the crash and develop evidence to understand what happened.
  • Claim filing: After investigating the case, we file the applicable claim.
  • Settlement negotiations: We negotiate with the insurer and review proposed terms with you.
  • Litigation and trial: When required, we file a lawsuit and take the case to trial.
  • Resolution: We carry the claim through its conclusion.

We prepare every case as though it’s going to trial, with litigation built into our approach from the start. We have handled more than 1,000 cases and recovered over $70 million, a record that informs the decisions our hit-and-run accident lawyers in Oklahoma City make from investigation through resolution.

What Counts As a Hit-and-Run in Oklahoma?

Under Oklahoma law, a driver commits a hit-and-run offense by failing to stop and comply with applicable accident-reporting requirements. The criminal case addresses the driver’s conduct after the collision and is separate from an injured person’s insurance claim or pursuit of civil damages.

A driver who fails to meet those duties may face a misdemeanor conviction, a fine of up to $500, and up to one year in county jail. Oklahoma law may also impose civil liability equal to three times the value of property damage caused by the accident when a driver leaves without complying with accident-reporting requirements.

Uninsured Motorist Coverage for Oklahoma City Hit-and-Run Injuries

Oklahoma insurers must offer uninsured motorist coverage for bodily injury, sickness, disease, or death caused by operators of uninsured and hit-and-run motor vehicles. The Oklahoma Insurance Department states that this coverage may pay when the responsible driver can’t be found to cover the damages.

The named insured or applicant may reject this coverage in writing. When it applies, we pursue a claim through the injured person’s own policy. Availability depends on the policy and the circumstances of the collision, so coverage can’t be assumed simply because the other driver fled.

Uninsured motorist bodily injury coverage and collision coverage address different losses. Bodily injury coverage concerns qualifying injuries, while collision coverage generally concerns vehicle damage. The policy determines which coverages are available for a particular accident.

Oklahoma Rules That May Affect Your Injury Claim

Several Oklahoma rules may affect a hit-and-run injury claim even when the fleeing driver hasn’t been identified. They govern filing deadlines, shared fault, and limits on certain damages.

Personal Injury Filing Deadline

Most Oklahoma personal injury claims are subject to a two-year filing deadline measured from the accident date. This statute of limitations governs the time for filing a lawsuit, not the time required to investigate or negotiate a claim.

Modified Comparative Negligence

Oklahoma uses modified comparative negligence, which accounts for each person’s share of fault. An injured person may recover when that person’s fault isn’t greater than the combined fault of the other responsible parties, but the damages are reduced by the injured person’s percentage of fault.

Noneconomic Damage Limit

For injuries occurring on or after September 1, 2025, Oklahoma generally caps noneconomic damages at $500,000. These damages compensate for losses such as pain and suffering rather than direct financial costs. Statutory exceptions apply to severe permanent injury and certain misconduct, while economic damages aren’t capped.
