What Constitutes a Wrongful Death?

A wrongful death occurs when a person’s demise is caused by the wrongful or negligent acts of another party (12 O.S. § 1053). Some potential causes of wrongful death include medical malpractice, workplace accidents, defective products or equipment, and motor vehicle collisions involving cars, trucks, rideshare vehicles, or motorcycles.

Who Is Eligible to File a Wrongful Death Claim in Oklahoma?

A wrongful death lawsuit must be filed by the personal representative of the decedent’s estate. The claim is brought on behalf of the surviving family members who suffered losses as a result of the death (“real parties in interest”). If the decedent did not designate a personal representative in their will, one may be appointed by the court.

Only certain surviving family members are legally entitled to compensation in a wrongful death claim, such as a spouse, children, or parents of a minor. Any compensation recovered is first awarded to the estate and is then divided among the victim’s eligible heirs and beneficiaries.
