How Long Do I Have to File a Truck Accident Lawsuit in Oklahoma?

In Oklahoma, you generally have two years from the date of the truck accident to file a personal injury claim against the responsible parties. This time limit is set by the state’s statute of limitations. The statute of limitations for wrongful death claims involving truck accidents is also two years, but this period starts running from the date of the victim's death, which isn’t always the date of the accident itself.

Even though you have up to two years to take legal action, you should get legal advice as soon as you can after a crash. Commercial trucking companies and their insurers begin investigating and building a defense immediately, and our attorneys must act fast to preserve logbooks, maintenance records, and other important evidence before it gets lost or destroyed. This helps us prepare the strongest foundation possible for your case.

How Do I Know If I Have a Truck Accident Claim?

If you suffered injuries in a collision with a commercial truck, you may have a personal injury claim if another party's negligence caused the accident. This could include someone other than the driver themselves.

Our attorneys can investigate many common forms of negligence that cause truck accidents, including:

  • Driver fatigue. Truck drivers operate under strict federal "hours of service” regulations that limit how long they can drive without rest. When drivers ignore these rules, or when trucking companies pressure them to meet unrealistic deadlines, extreme fatigue can impair the driver's judgment, reaction time, and attentiveness, which can then lead to devastating crashes.
  • Distracted driving. Truck drivers operate complex machinery and must maintain absolute focus. Negligence occurs when a driver engages in any activity that takes their eyes off the road, hands off the wheel, or mind off driving. This includes texting, making non-essential calls, eating, or manipulating a navigation system. A moment of inattention can have catastrophic results due to the truck's size and speed.
  • Improper truck maintenance. Trucking companies and independent operators must routinely inspect and maintain their vehicles. Negligence occurs when they fail to repair key issues like faulty brakes, worn tires, steering problems, or broken lights. These mechanical failures can make a tractor-trailer unreasonably difficult to control and directly cause an accident.
  • Speeding and reckless driving. Commercial trucks require significantly more distance and time to stop than passenger vehicles. When a truck driver exceeds the speed limit, drives too fast for road conditions, or engages in aggressive maneuvers like tailgating or improper lane changes, they substantially increase the risk and severity of a collision.
  • Improper cargo loading. Federal regulations specify how companies must distribute and secure cargo. If a truck's load is unstable, overweight, or improperly balanced, the cargo can shift during transit. This shift can cause the driver to lose control of the truck, particularly on curves or during sudden stops, resulting in a jackknife or rollover accident.
  • Driving under the influence of drugs or alcohol. A truck driver acts negligently when they operate a massive commercial vehicle while impaired by alcohol, illegal drugs, or even certain prescription medications. Impaired driving significantly compromises motor skills and judgment.
  • Lack of proper training or licensing: Trucking companies must hire only qualified drivers who possess the necessary licenses and relevant endorsements. Negligence applies if a company knowingly or unknowingly allows an unqualified, poorly trained, or uncertified driver to operate one of their commercial vehicles.
