Who Is Liable for a Dog Bite in Oklahoma?
Under Oklahoma’s strict liability law, the dog’s owner is typically responsible for dog bite injuries. This applies when the dog bites a person without provocation and the victim was lawfully on the property.
Does Oklahoma Have Strict Liability for Dog Bites?
Yes. State law holds dog owners strictly liable for bites if the victim did not provoke the dog and was legally on public or private property at the time (4 O.S. 42.1).
Can I Seek Compensation Even if the Dog Has Never Bitten Before?
State law does not require prior knowledge that the animal was dangerous, meaning the owner can be held strictly liable even if the dog was not aggressive in the past. However, there are certain exceptions to this rule, such as bites that occur in rural areas without U.S. mail delivery service (4 O.S. § 42.3). Do I Have to Prove the Dog Owner Was Negligent to File a Claim?
