  • Am I barred from recovering if I was partly at fault? Not necessarily. Oklahoma's modified comparative negligence rule (23 O.S. § 13) allows you to recover as long as you're 50% or less at fault, with your award reduced by your share.

For bodily injuries occurring on or after September 1, 2025, noneconomic damages such as pain and suffering are generally limited to $500,000 under 23 O.S. § 61.3. The limit does not apply to permanent and severe physical injuries or when the required findings are made concerning reckless disregard, gross negligence, fraud, intentional conduct, or malice. A separate $1 million limit applies to certain permanent mental injuries that severely impair employment or the ability to maintain a reasonable standard of living. Economic damages are not capped under this statute.
