- Is there a limit on what I can recover? For bodily injuries occurring on or after September 1, 2025, noneconomic damages such as pain and suffering are generally limited to $500,000 under 23 O.S. § 61.3. The limit does not apply to permanent and severe physical injuries or when the required findings are made concerning reckless disregard, gross negligence, fraud, intentional conduct, or malice. A separate $1 million limit applies to certain permanent mental injuries that severely impair employment or the ability to maintain a reasonable standard of living. Economic damages are not capped under this statute.

Can I File a Claim If I Was Treated at Urgent Care Instead of an ER?
Yes. The type of facility where treatment began does not determine whether you have a claim. Medical records should document the injury, symptoms, diagnosis, and recommended care, and consistent follow-up can help establish how the condition developed.
What If My Injury Symptoms Didn't Appear Until Days Later?
This is common, especially with soft tissue injuries and concussions. Seek medical attention as soon as symptoms appear, and don't assume a delayed onset means you don't have a claim.
Can I Recover If I Had a Preexisting Injury?
A prior condition does not automatically prevent recovery. The claim may include harm caused when an accident aggravates or worsens an existing injury. Medical records showing your condition before and after the incident can be important when the insurer disputes what changed.
What's the Difference Between a Settlement and a Verdict?
